“If elected, will you pack the Supreme Court? ”
The right wing is going nuts. Asking this question over and over again.
And for some reason I can’t understand, Vice President Biden is dodging the question.
It is not that hard to give a non-committal answer, while at the same time educating the American people about the ways in which the entire Federal Court system has been hijacked and manipulated under Mitch Mconnell’s leadership.
Obviously, I am not Biden’s speech writer. However, I couldn’t resist the urge to write a politician-style non-answer to this insidious question. Mr. Vice President, feel free to borrow some or all of the content, and help educate the public about what you KNOW is going on.

I have already promised to nominate a Black woman to the Supreme Court. And I pledge to you that my nominations for other Federal Court positions will reflect our nation’s diverse population. As you may know, the Trump administration has appointed a record 53 Circuit Court Judges. Not a single one of those 53 nominations was an African American. One single nomination was a Latinx American. And only a quarter were women. This is unacceptable.
So let’s talk about “packing” the court system. You know, the Senate, under the leadership of Mitch McConnell, has spent the past 4 ½ years manipulating the US court system. Most Americans are aware of the way in which the Senate blocked President Barack Obama from exercising his Constitutional duty to fill a Supreme Court vacancy when Justice Scalia died, 11 months before a new President would take office. The argument was, that with a Presidential election set to take place in less than a year, the “people should decide.” Meaning that the nomination should be left the the newly elected President. But when a vacancy was left by the death of Ruth Bader Ginsburg, just six weeks prior to the election, the Senate has decided that it should be Mitch McConnell and President Trump, not the people, who should nominate another Supreme Court Justice.
But there is a lot of behind the scenes manipulation that the American people may not be aware of in terms of Federal Court appointees. The very appointment of Amy Coney Barrett in 2017 to the United States Court of Appeals for the Seventh Circuit, was the result of a lesser known manipulation. You may not be aware of the fact President Obama had nominated Myra C. Selby to the vacant seat in January of 2016. Selby is a highly qualified Black woman, who had previously served on the Indiana Supreme Court, and had chaired the Commission on Race and Gender Fairness. Mitch McConnel refused to review her nomination for a year. And when that nomination expired, Justice Barrett was named and installed. Barrett’s 2017 appointment, by the way, was her first time serving as a judge.
This is only one example of the ways in which Mitch McConnell and his Senate have undermined the structure and composition of the Federal Courts of the United States of America.
If the American people select me as your next President, I will, work with Congress, in a transparent manner, to ensure that the highest qualified Americans are appointed to our Federal Court System. I will review and carefully consider any legislation passed by Congress to adjust the current structure of the court system. And I will uphold the Constitution of the United States.
